ChatGPT also told him he would need to experience between eight and ten more episodes before his condition would be considered serious.

Winters followed that advice. In July 2025, he suffered what the lawsuit describes as a "massive pulmonary embolism" caused by blood clots that brought him to the brink of death. One of his doctors blamed his immobility, which ChatGPT had recommended, for triggering the embolism. When Winters consulted ChatGPT again about groin tenderness on the day of his emergency, the chatbot drew on his spirituality, telling him that "God did not design your body to endlessly fail." That groin pain turned out to be the onset of the embolism.

This case appears to be the first to argue that a chatbot's advice directly harmed someone seeking guidance about a medical condition. Winters' legal team is seeking financial damages and stronger guardrails around ChatGPT's medical advice. They have also asked that ChatGPT Health, OpenAI's service designed to answer health questions, be blocked from operating pending a safety evaluation.

Why Does OpenAI's Disclaimer Matter Less Than You'd Think?

OpenAI spokesperson Drew Pusateri told CBS News that ChatGPT "is not a doctor and should never be used as a substitute for medical care, diagnosis or treatment." He argued that blaming chatbots alone for mishaps related to one's own care is "misguided" and "risks getting in the way of people accessing powerful new tools that can aid them in their health journey." OpenAI's terms of service state that outputs are used at the user's "sole risk" and are not a substitute for professional advice.

But legal experts say disclaimers have limits. James Grimmelmann, a professor of digital and information law at Cornell Law School, explained the problem: "At some point, the chatbot's own statements and actions belie any disclaimer." In other words, if a chatbot acts like a medical authority and gives specific health guidance, a fine-print disclaimer may not protect the company from liability.

The Winters case lands at a moment when millions of people routinely ask ChatGPT for help with everything from recipes to résumés to medical symptoms. OpenAI has faced additional lawsuits related to users' health and safety, including a suit by a Texas couple whose son died of an overdose after seeking drug information from ChatGPT.
