Brian Miller, a Democratic candidate for Montana's Eastern Congressional District who has tracked the debate closely and represented opponents of the Broadview project, highlighted a critical issue: companies are not being forthcoming about their operations.

"They don't disclose what they're doing with water. They don't disclose agreement; they use a lot of nondisclosure agreements to kind of hide the data that they are operating under. And so this causes a tremendous amount of concern for people, especially in eastern Montana. You know outsiders may come in and see the Yellowstone River and thing you guys got lots of water, no we don't," Miller said.

This lack of transparency has become a major sticking point. Communities worry that companies are making decisions about local water resources without adequate public input or disclosure of long-term impacts.

As hyperscalers and data center operators race to build facilities to support artificial intelligence workloads, they are encountering communities that want a seat at the table.
