xAI's Colossus 2 data center in Memphis, Tennessee, is powered by 59 gas turbines located mostly across the border in Mississippi, creating a regulatory and health dispute that highlights how AI infrastructure decisions in one state can harm communities in another. At least 57 of those turbines sit near Southaven, Mississippi, where residents already face elevated lung-disease rates and above-average pollution-related health risks. The unusual arrangement has sparked a lawsuit from the NAACP and environmental groups, who argue the company violated the Clean Air Act by operating turbines without proper permits.

What Emissions Are These Turbines Actually Producing?

The scale of potential pollution is significant. Reuters calculated that just 30 of the turbines could release approximately 2,500 tons of nitrogen oxides and around 4,000 tons of carbon monoxide annually under the operating conditions examined. These are estimates, not direct measurements of what residents actually breathe, but the numbers underscore why nearby communities are concerned.

Nitrogen oxides contribute to ground-level ozone and fine particle pollution, both of which can irritate airways and worsen asthma symptoms. Fine particle pollution has been linked to asthma attacks, heart problems, hospital visits, and premature death. Formaldehyde, another pollutant the turbines may emit, is classified as a hazardous air pollutant known to cause cancer. The health risk depends on concentration, exposure time, distance, weather, and personal vulnerability.

What makes this situation particularly troubling is the existing burden. Government data reviewed by Reuters suggested that many people living within five miles of the turbine site were Black and already faced above-average pollution-related health risks. Residents argue that new emissions should be judged alongside the area's existing industrial traffic and pollution, rather than considered separately.

How Are Regulators and Companies Handling the Permitting Dispute?

The permitting process reveals a fundamental disagreement about what counts as temporary versus permanent infrastructure. xAI argued that some turbines did not need traditional air permits because they were portable and would remain at the location for less than 12 months. Mississippi regulators initially treated certain units as temporary mobile equipment exempt from certain permit requirements.

In March 2026, Mississippi regulators approved an air permit allowing xAI to construct and operate 41 permanent gas-fired turbines in Southaven. However, environmental organizations appealed the permit and questioned whether regulators fully considered existing emissions, pollution controls, and combined effects on nearby communities before allowing the much larger permanent power operation.

Environmental groups reject the company's interpretation of the rules. They argue that equipment supplying continuous power at a single location should be subject to the same Clean Air Act protections as other stationary sources, regardless of whether each turbine can technically be moved. The NAACP and environmental legal groups sued xAI in April 2026, accusing the company of violating the Clean Air Act by operating more than two dozen turbines without required permits. The response highlights a basic lesson for large developments: community benefits may be appreciated, but they rarely replace transparent permitting, pollution monitoring, public meetings, and direct answers about environmental effects.

The xAI dispute reflects a much larger national challenge facing the technology industry. Artificial intelligence facilities are expanding rapidly, and data centers need round-the-clock electricity that may exceed what local power systems can quickly provide. A Department of Energy-backed Lawrence Berkeley National Laboratory report estimated that data centers could account for approximately 6.7% to 12% of U.S. electricity use by 2028.

Developers are exploring multiple solutions to power these facilities, including grid upgrades, renewable energy, batteries, nuclear power, and onsite generators. The choice matters significantly because each option brings different costs, construction timelines, emissions, and effects for neighboring communities.
